Selling rules

1. Subject

These general terms and conditions define the rights and obligations of the parties in the context of distance booking of services offered by our establishment, whose contact details are specified in this reservation confirmation document. They govern all necessary steps for booking and managing reservations between the contracting parties. The client acknowledges having read and accepted these general terms and conditions of sale and the sales conditions of the reserved rate available on our booking platform. These general terms and conditions of sale apply to all reservations made via the internet through our booking platform.

2. Reservation and Receipt of the Booking

Each service has its own conditions that must be reviewed and properly applied on the platform (hotel, visa, visa appointment, etc.). The client will make the reservation for the desired service while considering these conditions (confirmation, modification, and cancellation). Upon client validation, a confirmation will be sent by email and to the affiliate's account.

3. Cancellation or Modification by the Client

The sales conditions of the reserved rate specify the terms for cancellation and/or modification of the reservation. Reservations with prepayment cannot be modified or canceled. Advance payments, such as deposits, are non-refundable. If mentioned in the sales conditions of the rate, cancellations can be made directly with the establishment, with contact details provided in the reservation confirmation email. All reservations are personal and cannot be transferred to a third party, whether free or for a fee.

4. Consumption of the Service

In accordance with regulations in certain countries, clients may be required to complete a police form upon arrival. Clients will need to present an ID to determine if they need to complete the form. Any behavior contrary to public morals and order will result in the establishment asking the client to leave without compensation or refund if payment has already been made. Clients agree to adhere to the establishment's internal regulations, if applicable. Non-compliance with these regulations may result in the client being asked to leave without compensation or refund.

5. Liability

Photographs on our booking platform are non-contractual. Despite best efforts to accurately represent the services, variations may occur between booking and service consumption. The establishment is not liable for non-performance or improper performance of the reservation due to force majeure, third parties, the client, internet unavailability, website access issues, external intrusion, computer viruses, or unauthorized prepayment by the client's bank. Any irregular, ineffective, incomplete, or fraudulent reservations or payments due to client fault will result in order cancellation at the client's expense, without prejudice to any civil or criminal action.

6. Complaints

Complaints regarding non-performance or improper performance of reserved services must be submitted in writing within 3 days of the establishment's departure date, or they will be considered forfeited.

7. Prices

Prices related to service reservations are indicated before and during booking. Prices are confirmed to the client including VAT and are valid only for the duration specified on the booking platform. All reservations, regardless of origin, are payable in Algerian local currency. Unless otherwise stated on the booking platform, additional services are not included in the price. Taxes (local taxes, tourist taxes, etc.), if applicable, are to be paid directly at the establishment unless mentioned in the reservation. Any modification or introduction of new legal or regulatory taxes imposed by competent authorities will be automatically reflected in the prices at the time of billing.

8. Payment

Clients have several options to pay and secure their reservation. Currently, they can pay directly at the agency or use the "pay later" option to secure the reservation while deferring payment to a later date. This flexibility helps clients manage their finances more effectively. Additionally, an online payment option will soon be available, allowing the use of standard credit cards as well as the Dhahabia card. This new feature aims to offer greater convenience and simplify the payment process for clients.

9. Privacy

Clients are informed on each personal data collection form about the mandatory or optional nature of responses via an asterisk. The information collected is intended for the establishment, StardustBooking.com, its entities, partners, and service providers (including online payment providers). The client authorizes Stardust Booking.com to share personal data with third parties if such communication is necessary for fulfilling the operations required by our entity, according to these general terms and conditions and the Client Data Protection Charter. Specifically, during online payment, the client's banking details will be transmitted by the payment provider to the establishment's bank for contract execution.

10. Proof Convention

Entering the required banking information and accepting these general terms and conditions and the reservation confirmation constitutes an electronic signature with the same value as a handwritten signature. Electronic records kept in StardustBooking.com’s computer systems will be maintained under reasonable security conditions and considered as proof of communications, orders, and payments between the parties. The client is informed that their IP address is recorded at the time of booking.

11. Force Majeure

Force majeure refers to any external event that is both unpredictable and insurmountable, preventing either the client or the establishment from fulfilling all or part of the contractual obligations. Force majeure or fortuitous cases are those commonly recognized by French court jurisprudence. Neither party can be held liable to the other party for failure to perform obligations due to a force majeure event. Force majeure suspends mutual obligations, and each party bears the costs resulting from it.

12. Dispute Resolution

These General Terms and Conditions are governed by the laws of the country, without prejudice to any mandatory protective provisions that may apply in the consumer's country of residence.

13. Entirety

These General Terms and Conditions, the sales conditions of the reserved rate, and the reservation confirmation express the entire obligations of the parties. No general or specific condition communicated by the client can be incorporated into these general terms. The documents forming the contractual commitments between the parties are, in descending order of priority, the reservation confirmation (including the special conditions of the reserved rate) and these general terms and conditions. In the event of a conflict between the reservation confirmation and the general terms, the provisions in the reservation confirmation will apply. These online general terms and conditions may be amended or supplemented by the establishment at any time. In such cases, the new version will be posted online, and it will automatically apply to all clients from the date of publication.
